Fair Work Reforms

On 7 December 2023, the Government passed several parts of the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023 (Bill), which includes various changes including:

  • significant labour hire reforms
  • expanded union delegate rights
  • the introduction of a federal wage (and superannuation) theft offence

Some of these changes will come into effect almost immediately and they will have a significant impact on many businesses.
The new labour hire provisions create a right for various parties to apply to the Fair Work Commission (FWC) for a regulated labour hire arrangement order (RLHAO). The Bill includes Same Job, Same Pay, Wage and Superannuation Theft and Work, Health & Safety legislative changes.

Most of the provisions will come into effect in July and August this year. See the table below for more information.
